The aim of Legal Zoning Plan No. 54/1 “Unteres Tor II” is to lay the basis for planning permission for a building complex to be erected on disused land directly next to the Old Town and integrating retail, cinema, services, a medical center, offices, hospitality, and a hotel (“NeuerMarkt” project). In relation to the project, a local vote was held in fall 2011, which confirmed the idea for the facilities and the size of the retail spaces (around 13,100 square meters). Crunch issues addressed by the legal zoning plan were not only ensuring the retail spaces were of the right sizes (relevant to malls) and would be compatible with the surroundings, but also the potential increase in traffic volumes and access to “Neuer Markt” as well as the associated noise emissions – in particular with regard to the adjoining noise-sensitive housing to the north. Expert opinions were also commissioned investigating air hygiene and hydrogeology in detail. Parallel to the compilation of the legal zoning plan the preparatory land use plan was also amended and a simplified regional planning procedure conducted. Following the commencement of construction work, the marketing of the planned areas and building progress have resulted in a need for adjustments to the underlying planning in some sections, such that the legal zoning plan has been amended in two further planning stages. The first amendment saw adjustments to the definitions relating to the structure (the height of the built facilities), the areas of land where building is permitted, and visual, design and functional optimization of plans; the second amendment focused instead on various adjustments relating to the facilities mix in “Neuer Markt” and issues relating to the laws on noise emissions.
